If you are involved in creation of plant varieties, it is worth to register and get a patent for protecting your exclusive rights on the created variety.

     On the territory of the Republic of Belarus the right to a plant variety is protected by the Republic of Belarus Law on “Patents for Plant Varieties”. This right is attested by a Plant Patent which is effective for 25 years since the date of registration.

     Variety gets legal protection only in case it possesses certain qualities. That is, it should be new; distinctive from any other widely-known variety of plant; the reproductions of this plant are supposed to be uniform; and finally it should be stable, in other words, its main features wouldn’t change after reproduction.

     The Plant Patent is granted to the author of the variety, a person, named in the application by the author; or to the hair of the author. Author of the variety, in its turn, is considered to be the person who creative worked it out.

     Any violations of the Plant Patent must be immediately stopped, and losses must be compensated by the Violator to the author in accordance with Belorussian Law System.

     The right to Plant Patent can be passed by the Owner to any physical or legal person in established order.
